Sha Diddy Colmes, awaiting trial in a Brooklyn Detention Center, stands accused of coercing people into sexual performances and controlling a criminal enterprise that involved sex trafficking. Alongside these accusations, the NDAs he allegedly made people sign are now under intense scrutiny, bringing into question how far these legal agreements can stretch—particularly when criminal conduct is involved.

NDAs, commonly used by celebrities to protect their privacy, are agreements between two parties that keep sensitive information confidential. While commonplace in high-profile circles, the Colmes case raises an essential question: can these NDAs be used to silence witnesses or victims of illegal activities?

Typically, NDAs cover personal life details, business secrets, or interactions between celebrities and their employees. However, the NDAs associated with Colmes are alleged to be far broader than the norm, covering not just his personal life but also the actions and conduct of his associates, including his own past romantic relationships. Public policy prohibits using NDAs to cover up criminal activity, making it unlikely that any NDA prohibiting someone from disclosing illegal activities, such as sex trafficking or gun violence, would hold up. And recent laws, like the Speak Out Act, protect victims of sexual misconduct from being silenced by NDAs, further diminishing the validity of such agreements in cases like this.

Moreover, the possibility that these NDAs might stretch beyond a celebrity’s lifetime, as suggested by Colmes’ alleged agreements, is particularly unusual. The language, suggesting the NDA would last for the “life of the artist plus 20 years or 70 years, whichever is longer,” was shocking to experts. These broad attempts to extend control well into the future highlight just how extreme these NDAs may have been.

So, while NDAs are legal tools celebrities frequently use to maintain privacy, the Colmes case reveals a darker side to these agreements. When NDAs become vehicles for hiding criminal behavior, they not only lose their legal standing but also highlight the fine line between privacy and accountability.
